Today I leave the report Privacy and criminal protection to the Minister of Justice. It contains a broad review of the criminal protection of individuals' privacy and proposals for a strengthened criminal protection. I and the investigation experts agree on the proposals in the report.
We can use technology to reach each other anytime and anywhere to change or to disseminate opinions and information, unconstrained by national borders. It is an achievement for freedom and a cornerstone of a democratic discourse. Meanwhile, our investigation shows clearly that the increased possibility to collect and disseminate information involves risks for privacy. It has become easier to damage the integrity of others through the ability to remain anonymous and to express their opinions about others facing a "public" online. Individuals are difficult to remove information that has been disseminated over the Internet and can be raised again and again for a long time.
An improved penal protection of privacy is needed and it should be able to answer certain questions. What do I as an individual withstand the kind of cruelty, abuse, spreading rumors, or invasion of privacy? What crosses the border to make it a criminal offense? How much society can tolerate the insults and threats between individuals? When it becomes a social problem and a threat to democracy that people are violated and threatened for their opinions and then did not dare to participate in the debate and raising awareness?
With the increased ability to disseminate images or other derogatory information, the risks of being exposed to serious criminal defamation larger. Therefore, we suggest that the rights of crime victim compensation shall include rights violations by grossly defamatory.
The Constitution and Articles 8 and 10 of the Convention requires adequate protection for both privacy and freedom of expression and the right balance between these important interests. We report a number of proposals which assumes that we must uphold freedom of expression and at the same time meet the needs of better penal protection of personal privacy.
A new penal provision on unlawful infringement of privacy outside the constitutionally protected area is needed. It involves criminal liability for invasion of anyone's privacy by disseminating images or other data which will considerably harm the task or the picture tube. The provision includes images or data on sex life, health, crime, people in very vulnerable situations, nudity or similar images or information about someone's private life. One example is so-called adult Revenge sex tapes which spread and now sometimes considered defamation. The provision concerning unlawful infringement of privacy makes it clear that the spread of sex tapes is a criminal offense and involves an illegal intrusion into personal privacy. Other examples are the spread of highly private information about the disease or if the person has been exposed to a serious crime. We propose an exemption from criminal liability if the spread was justifiable, for example, if there was a clear public interest that the information was spread.
Wider responsibility for the assault. New technology for communication increases the risk of intimidation. Our investigation shows that it is customary to threaten to spread intrusive images or data, such as sex tapes and threatening someone's mind. We propose that the provision on unlawful threats extended to make it a criminal offense to direct threat to the freedom and peace, for example, to threaten an unlawful infringement of privacy or a gross invasion of privacy. Threats that are likely to produce serious concern at the threat to be penalized.

We suggest that the rights of crime victim compensation should be extended to aggravated libel. Criminal injury compensation may be paid by the state if someone violated by a crime that involves an attack on the person, freedom or peace. This means that if our proposal for unlawful infringement of privacy is implemented, crime victim compensation be granted. Under the current rules, criminal injuries compensation is not paid for defamation offenses. The Riksdag agrees with what is stated in the motion of the need to combat threats and violations online and announce this to the government.
Reason
 
In recent years, the climate talks on Internet and social media have become increasingly characterized by intimidation, hatred, and the violations. Therefore, the government should take the necessary steps to reverse the negative trend that we can now observe.
 
 
 
Concrete measures, skills enhancement and prioritization of threats and harassment online is vital to safeguard an open and inclusive tone in Sweden. Both online and in the rest of society.

So whats your issues? you can't be an butthole anymore at any given time to anyone you like and thats now an issue? it was never legal to behave like this in many countries and could get you in front of a court anyways now this also counts for the digital world. Not a problem at all if you know how to be not a said hole.

 

Time and society advances, if people think the internet was a right free area for many things they were just wrong, many stuff was tolerated due to the lakc of tools and manpower to just enforce the laws. But times change.
